The paper analyses the question about the nature of the exception of the delay in denying a signature, whether to frame it in the absolute exceptions, which may be raised by the court ex officio, or in the relative exceptions, which may be raised only by the interested party. The second solution, in the light of the recent outcomes of the Supreme Court, has relevant effects in relation to the subsequent request to verify the signature.

The problem of the custody exchanges during the health emergency means an excellent test to understand how courts react in the time of a real exceptional law, about a subject very important in family law, concerning the interest of the child to a personal relationship and direct contact with both parents and their custody and visiting rights. The paper reveals that there is no single rule but only guiding criteria to be adopted in the light of the specific features of the concrete case
